《海南省经济适用住房管理实施办法》已经省政府同意,现印发给你们,请遵照执行。

海南省经济适用住房管理实施办法
第一章 总 则
第一条 经济适用住房制度是住房保障政策体系的重要组成部分。为建立和完善住房保障制度,规范经济适用住房管理工作,根据国务院《关于解决城市低收入家庭住房困难的若干意见》(国发 〔2007〕24号)、住房和城乡建设部等七部委《经济适用住房管理办法》(建住房〔2007〕258号)及海南省人民政府《关于解决城镇低收入家庭住房困难的实施意见》(琼府〔2007〕77号)等有关规定,结合我省实际,制定本办法。
第二条 本办法所称经济适用住房,是指政府提供政策优惠,限定套型面积和销售价格,按照合理标准建设,面向本地城镇低收入及中等偏低收入住房困难家庭出售,具有保障性质的政策性住房。
本省行政区域内经济适用住房的建设、供应和管理工作,适用本办法。
第三条 经济适用住房建设和管理工作坚持政府主导、社会参与,并遵循以下原则:以市县为主、统筹安排;自愿申请、逐级审核;公开透明、公平公正;严格交易、动态监管。
第四条 省政府对本省经济适用住房管理工作负总责。根据住房发展规划和年度计划,每年与市、县政府签订目标管理责任书,并组织考核,实施目标责任制管理。
省建设行政主管部门会同发改(价格)、监察、财政、国土资源、税务及金融管理机构,按照各自职责,指导和监督全省经济适用住房建设、管理工作。
市、县政府应当建立和完善经济适用住房建设、管理以及销售、购房资格审查等制度;根据本地经济社会发展水平、居民住房状况和收入水平等因素,制定住房发展规划和年度计划。市、县住房保障主管部门负责经济适用住房建设、管理的具体实施工作。
第五条 省建设行政主管部门建立全省统一的住房保障信息管理系统,各市、县建立相应的经济适用住房管理信息平台,对经济适用住房建设、供应和需求及住房保障制度实施情况进行动态管理。
第二章 开发建设
第六条 坚持政府总揽、合理布局、综合开发、规范运作的原则,通过集中、分散、配建等方式开发建设经济适用住房。
第七条 集中建设经济适用住房是指市、县政府根据住房发展规划和年度建设计划,确定经济适用住房建设项目,由住房保障主管部门、非赢利性机构或以项目法人招标的方式选择的房地产开发企业实施的建设方式。
市、县政府应结合廉租住房建设,在经济适用住房建设项目中配建廉租住房,配建比例可根据实际情况合理确定。
第八条 分散建设经济适用住房是指整合现有单位土地资源、危旧房改造等方式获得建设用地,个人出建安成本,单位资助公共部分,政府减免有关税费,由住房保障主管部门统一项目审批、统一组织建设实施、统一供应对象的建设方式。
分散建设的经济适用住房在优先满足供地单位符合经济适用住房保障条件职工需要的基础上,可统一向其他低收入及中等偏低收入住房困难家庭调配出售。
第九条 配建经济适用住房是指市、县政府采取招标、拍卖、挂牌方式出让商品住房用地时,提出在项目中配建经济适用住房的要求,由开发企业在商品住房小区中配套建设经济适用住房的建设方式。
市、县政府应当明确该项目配套建设经济适用住房的建设总面积、单套建筑面积、套数、套型比例、建设标准以及建成后移交或者回购等事项,并以合同方式约定。
配建经济适用住房的建设项目用地应在供地公告中注明配建的开发条件并以招标、拍卖或者挂牌方式出让,确需缓交或分期缴交配建部分土地面积出让金的,应报有关部门批准,并在用地合同中约定。
第十条 经济适用住房原则上以中小套型为主,参照我省职工住宅建筑面积标准适度控制建筑面积。市、县政府可以根据本地区居民的收入和居住水平等因素,合理确定经济适用住房不同套型的比例。经济适用住房建设必须严格执行保障性住房建设技术规定。
第十一条 经济适用住房开发建设享受以下优惠政策:
(一)建设用地以行政划拨方式供应。经济适用住房的建设用地必须符合土地利用总体规划和城市总体规划,纳入土地利用年度计划统筹安排,优先安排使用存量闲置建设用地,优先保障供应。
(二)税收减免按《财政部、国家税务总局关于廉租住房经济适用住房和住房租赁有关税收政策的通知》(财税〔2008〕24号)执行。
(三)各银行业金融机构按照《经济适用住房开发贷款管理办法》(银发〔2008〕13号)的规定向经济适用住房建设单位发放经济适用住房开发贷款,经济适用住房建设单位可以以在建项目作抵押向商业银行申请住房开发贷款。购买经济适用住房可优先办理住房公积金贷款。
(四)免收建设和经营中的行政事业性收费。
(五)小区外基础设施建设费用由政府负担。
市、县政府可以根据本地实际情况,依法制定其他优惠政策,减免有关费用,并向社会公布。
第三章 供应对象
第十二条 经济适用住房供应对象是本地低收入及中等偏低收入住房困难家庭。低收入及中等偏低收入线标准和住房困难标准,由市、县政府按有关规定每年向社会公布一次,实行动态管理。符合下列条件的家庭可以申请购买一套经济适用住房:
(一)具有当地城镇居民户口(含符合当地安置条件的军人);
(二)无房或现住房面积低于市、县政府规定标准的住房困难家庭;
(三)家庭收入符合市、县政府划定的收入线标准;
(四)市、县政府规定的其他条件。
第十三条 居民在申请期限内向住房保障主管部门申请购买或者承租经济适用住房应提供以下材料:
(一)本人家庭户口本、成员身份及婚姻状况证明;
(二)民政部门出具的低收入及中等偏低收入证明;
(三)所在单位或者居住街道办事处出具的住房情况证明;
(四)市、县政府规定的其他证明材料。
第十四条 住房保障主管部门按以下程序进行审核:
(一)初审:住房保障主管部门收到申请后进行初审,经过初审符合前款规定的,应当予以受理。
(二)复审:受理申请后,可以通过查阅房产登记资料、入户调查、邻里访问以及信函索证等方式对申请者的情况进行审查。
(三)公示:对符合条件的申请者应当在申请者现户籍地及居住地社区予以公示,公示内容包括申请者姓名、家庭收入及住房情况。
(四)批准:公示后有投诉举报的,住房保障主管部门应当会同有关部门进行调查、核实;对不符合规定条件的申请人,取消其申请资格并以书面形式告知;对无投诉举报或对投诉举报经查证不属实的,应当发放准予购买经济适用住房的核准通知,注明可以购买的面积标准。
第十五条 申请者凭准购通知书购买经济适用住房,经济适用住房不得销售给未取得准购通知书者。准购通知书持有人的数量多于经济适用住房房源时,应当按照收入水平、住房困难程度和申请顺序等综合条件排序或者公开摇号的方式确定购买人。
对拆迁安置户、重残疾人员、患大病人员、优抚对象、复员军人等住房困难家庭应优先安排。
第四章 销售价格
第十六条 经济适用住房基准价格由开发成本、税金和利润三部分构成。开发成本包括征地和拆迁安置补偿费、勘察设计和前期工程费、建筑安装工程费、管理费、贷款利息;税金依照国家规定的税目和税率计算;利润按不高于3%核定。住房保障主管部门直接开发建设的,不得有利润。
设区城市人民政府可根据地段等因素核定经济适用住房指导价。
第十七条 经济适用住房的基准价和指导价由市、县价格主管部门会同住房保障主管部门审核确定,报市、县政府批准向社会公布。
各市、县经济适用住房基准价和指导价需报省发改(价格)、建设行政主管部门备案。
第十八条 经济适用住房销售应当实行明码标价,不得在标价之外收取任何未予标明的费用。价格主管部门应依法进行监督管理。
第十九条 职工购买分散建设的经济适用住房,原则上按建设综合成本出资。如财政或单位有条件资助公共配套设施、房屋公共部分和政府减免有关税费后的其他公共费用,享受面积标准内的购房面积可按建筑安装成本出资,超标面积部分按同地段普通商品住房价格确定。
第五章 售后管理
第二十条 居民购买经济适用住房后,应当按照规定办理土地、房产权属登记。权属登记部门在办理权属登记时,应当在权属证书中注明经济适用住房、划拨土地、购买价格、准购面积和实际购买面积等内容。
第二十一条 经济适用住房属于政策性住房,购房人拥有有限产权。购买经济适用住房不满5年,不得直接上市交易,确需转让经济适用住房的,由政府按照原价格并考虑折旧和物价水平等因素进行回购。回购的具体办法由市、县政府研究制定。
购买经济适用住房满5年,购房人上市转让经济适用住房的,应按照届时同地段普通商品住房与经济适用住房差价的一定比例向政府交纳土地收益等相关价款,具体交纳比例由市、县政府确定,政府可优先回购;购房人也可以按照政府所定的标准向政府交纳土地收益等相关价款后,取得完全产权。
应在购房合同中将上市交易交纳价款和政府回购的有关规定予以载明。
政府回购的经济适用住房,仍应用于解决低收入及中等偏低收入家庭的住房困难。
第二十二条 已经购买经济适用住房的家庭又购买其他住房的,原经济适用住房由政府按规定及合同约定回购;已享受政策性住房优惠的家庭不得购买经济适用住房;已购买经济适用住房的家庭不得再购买经济适用住房。
第二十三条 享受廉租住房保障的承租人购买经济适用住房后,住房保障主管部门应当收回其承租的廉租住房、停止发放租赁补贴。
第六章 法律责任
第二十四条 经济适用住房建设单位将经济适用住房建设用地用于普通商品住房等其他房地产开发经营或擅自改变土地用途的,由国土资源行政主管部门依照土地管理法律、法规予以处罚。
第二十五条 经济适用住房建设单位擅自提高经济适用住房的销售价格或者有其他违反价格管理行为的,由价格行政主管部门责令限期退还收取的差价款,并依法进行处罚。
第二十六条 经济适用住房的购买人有下列情形之一的,由住房保障主管部门进行处理:
(一)弄虚作假、隐瞒家庭收入和住房条件等真实情况,骗购经济适用住房的,责令限期交回住房;不能交回的,责令其按照市场价格补缴差价款;
(二)违反本办法规定上市交易的,责令其按照市场价格补缴差价款,并不予批准其再次购买经济适用住房;
(三)将未取得完全产权的经济适用住房用于生产经营性活动的,没收非法所得并责令限期改正,逾期仍不改正的,责令其按照市场价格补缴差价款。
对具有前款所列行为的购买人,住房保障主管部门还可提请其所在单位依法给予行政处分。
第二十七条 住房保障主管部门、其他行政机关和有关单位的工作人员,以及有关单位中由行政机关任命的工作人员,有下列行为之一的,对直接负责的主管人员和其他直接责任人员依法给予行政纪律处分;涉嫌犯罪的,移送司法机关依法追究刑事责任:
(一)索取和收受他人财物的;
(二)未按规定程序和条件进行购房资格审查的;
(三)违法向经济适用住房开发建设单位收费的;
(四)弄虚作假,协助当事人隐瞒真实情况或为经济适用住房购买人提供虚假证明材料的;
(五)不履行或者不正确履行法定职责并造成严重后果的。
第七章 附 则
第二十八条 本办法未尽事宜,按照国家的有关规定执行。
第二十九条 本办法由省建设厅会同省发展和改革委员会、省监察厅、省国土环境资源厅、人民银行海口中心支行、省地方税务局负责解释。
第三十条 本办法自公布之日起施行。
